Your rights exist, but they don’t apply automatically
European law provides a clear framework for family reunification, but each file must still prove:
- The exact nature of the family tie (marriage, legal cohabitation, ancestry, lasting partnership, etc.)
- The regularity and sufficiency of the European citizen’s income
- The existence of adequate housing and health insurance
- Past cohabitation or financial dependence in certain cases

Who is concerned and what must be proven?
Family reunification with an EU citizen applies to several categories of relatives, each with its own conditions:
- If you are married or a legal partner: you must provide an official document, prove the EU citizen has sufficient housing, health insurance, and stable resources.
- If you are in a lasting relationship (even without marriage or legal cohabitation): you can prove your tie through cohabitation of more than one year, a common child, or written evidence (photos, messages, etc.).
- For dependent children: the condition applies until 21 years, or beyond if you prove financial dependence and effective custody.
- If you are a parent of the EU citizen: you must demonstrate financial or medical dependence, as well as past cohabitation.
- For other family members up to the 4th degree (siblings, grandparents…): you must prove either prior cohabitation, or financial dependence, or need for assistance for health reasons.
Even if you are already in Belgium, including in irregular residence, the procedure remains accessible in certain cases.
