How to submit an application from abroad

It is possible to apply for a provisional stay on humanitarian grounds, even though these grounds are not precisely defined by law.

Minimum conditions

  • Proof of sufficient resources of the person hosting you in Belgium
  • Clear supporting documents of the humanitarian situation invoked

The authorities apply a strict criterion in the assessment of this type of application.

How to submit an application from within Belgium: the 9bis

In principle, any application for a stay of more than three months must be submitted from the country of origin, through the Belgian diplomatic post.

Exception: Article 9bis

A person already present in Belgium, even with an irregular stay, may submit an application on the spot under certain conditions.

Conditions for a 9bis application

You must:

  • Be in possession of an identity document (even expired): passport, national identity card or equivalent travel document
  • Demonstrate exceptional circumstances preventing or making a return, even temporary, to your country of origin very difficult
  • Invoke serious and documented humanitarian reasons
  • Pay a fee of 343 euros, unless you are under 18 years of age

Good to know This is not an automatic right, but an exceptional measure.
